How to Obtain a Site License to Fish Trek or Preposition Pinball and Other Games

  1. If you are in charge of the computer or language lab responsible for the purchase of site licenses, read and print out our Terms and Conditions for Use (below).
  2. Print out and complete the Online Site License Agreement Form.
  3. Follow the instructions at the top of the Online Subscription Agreement for submission with the Terms and Conditions.
  4. You will receive an acknowledgment and notification that the license is active from the University of Michigan Press.

Terms and Conditions for Use of ESL CD-ROMs

  1. Scope of License.

    This license will cover access to the product during the 12-month academic year (August 1-July 31) during which the site license fee has been paid. Pro-rated fees must be negotiated if you want to start the license at any time before August 1 in a calendar year.

  2. Terms and Fees.

    Once signed, this Agreement will remain in effect thereafter for successive academic years as long as license fees are paid. Either party may terminate this Agreement, effective on the next renewal date, by at least 30 days' written notice to the other party.

    The annual fee for this subscription may be raised by written notice to the licensee. Notice will be provided at least two months prior to the succeeding renewal date (August 1). The fee for each annual renewal of this subscription must be paid on or before August 1 or the renewal will be invalid.

    Licenses are only valid in the United States and Canada.

  3. Copyright.

    Fish Trek and Preposition Pinball and Other Games and their contents are subject to copyright and other rights of the publisher (The Regents of the University of Michigan) under the laws of the United States and the country of use.

    The licensee acknowledges that it has no claim to ownership by reason of its use of or access to Fish Trek or Preposition Pinball and Other Games. Recompiling, copying, publication, or republication of the data, or any portion thereof, in any form or medium whatsoever, may be done only with specific written permission from the University of Michigan Press.

  4. Suspension or Termination of License.

    The UMP reserves the right to suspend and/or terminate this license for substantial or material breach of this agreement without prior notice. Written notification of such suspension or termination will be provided to the subscriber. No refund will be provided.

  5. Disclaimer of Warranties/Limitation of Liability.

    a. The UMP warrants that it is entitled to grant the licenses outlined in this Agreement but makes no other warranties or representations of any kind, expressed or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

    b. The UMP will not be responsible for incidental, consequential, or any other damages arising out of or in connection with the service or materials provided hereunder. The UMP warrants for a period of 90 days from date of purchase that the media on which the software is recorded will be free from defect in material and workmanship under normal use.

    c. The product is provided on an "as is" basis. The user agrees that all use of it is at the user's sole risk and that the UMP will have no liability to any person or any loss or damage arising out of use of, or inability to use, this product.

  6. General.

    a. This agreement constitutes the entire agreement of the parties and supersedes any prior communication between the parties with respect to the subject matter hereof. It may be amended only by a written instrument signed by both parties.

    b. The subscriber may not assign or transfer its rights under this Agreement.

    c. This Agreement shall be governed by the laws of the State of Michigan. The UMP and the Regents of the University of Michgian, in their individual capacities, shall in no manner, individually or collectively, be liable for any damage arising out of or related to this Agreement. All claims, demands, or actions hereunder shall be filed against the Regents of the University of Michigan in a corporate capacity and shall be brought in the Michigan Court of Claims.
